Kishmakes Privacy Policy

Kishmakes ("Kishmakes", "we", "our") is committed to maintaining the privacy of its users ("you", "user"). The following information describes how Kishmakes collects and processes information about you when you use our Platform (as defined below).

1. General

Kishmakes provides an AI-driven 3D printable model generation platform ("Platform") which enables users to input text or image prompts to generate digital 3D models. Kishmakes acts as an aggregator of third-party AI engines to provide these services. Payment processing and distribution for the Platform are managed by Cubee Inc.

2. Collecting Information

We collect information through your use of the Platform. Some is collected automatically (non-personal), and some is collected when you interact with us (personal).

Automatically Collected Information: Non-personal information including session durations, content accessed, technical information about your computer/connection, and usage frequency.

Personal Information: Information by which you can be identified, collected only if received voluntarily:

  • Sign-up: Name and email address. If registering via Google/Facebook, we receive access to information permitted by your settings (full name, email, profile picture).
  • Prompts & Content: We collect the text prompts and/or images you upload to generate 3D models.
  • Payment Information: Payment is handled by Cubee Inc. and their third-party processors. Kishmakes does not store your credit card details; these are secured by Cubee Inc. under high-security standards.

3. Use of Information

We use Personal Information for the following business purposes:

  • Providing Services: To generate 3D models based on your prompts and provide technical assistance.
  • Improvement & Development: To analyze feedback and evaluate the effectiveness of our AI aggregation logic.
  • Safety & Security: To detect and prevent fraud, unauthorized activity, or "prompt injections" that violate our Terms of Service.
  • Marketing: To provide personalized content and features based on your past use of the Platform.

4. Disclosure and Transfer of Data

We may share your Personal Information with:

  • Third-Party AI Providers: Your prompts are passed to our 3rd party providers (e.g., OpenAI, Tripo, Nano Banana) solely to fulfill your generation request. Important: Kishmakes and its current providers do not use your specific data to train their models.
  • Cubee Inc.: As our exclusive distributor and payment processor, your account and transaction data are shared with Cubee Inc. to facilitate billing and access.
  • Legal Requirements: To comply with a search warrant, subpoena, or court order, or to protect the safety of our users and the public.

The authority supervising such activities is the Israeli Privacy Protection Authority, and you have the right to file a complaint with it.

5. Your Rights

You have the right to request access to, modification of, or deletion of your Personal Information.

Deletion: To delete your data, please contact kishik@gmail.com. We will act in accordance with applicable law, though we may retain certain information as required for legal/tax purposes.

EU/EEA Rights: If you are in the EU/EEA, you have additional rights to object to processing, request data portability, and request erasure ("right to be forgotten").

6. Cookies

We use "cookies" to identify how users use the Platform and to remember your preferences. You may reject cookies via your browser settings, though some features of the Platform may be disabled.

7. Data Security & Retention

Security: We deploy industry-standard measures to ensure the security of your data. However, transmission over the internet is at the user's own risk.

Retention: Kishmakes generally retains project history and process images for one (1) year. We do not retain information longer than necessary for our reasonable business and lawful needs.

8. Intellectual Property and Takedown Requests

Transparency: When we receive a valid DMCA or copyright takedown notice, we may provide a copy of that notice (including the name and email address of the complainant) to the user who generated the allegedly infringing content. This is done to allow the user to defend their use of the platform.

Legal Compliance: We may store records of copyright claims and counter-notices indefinitely to comply with our legal "Safe Harbor" obligations and to identify repeat infringers.

Identity Disclosure: Pursuant to Chapter H1 of the Israeli Copyright Act, we may be required by court order to disclose the identity of a user allegedly involved in copyright infringement via our network.

9. Global Compliance

CalOPPA (California): We provide a conspicuous link to this policy and allow users to request information changes via email.

CAN-SPAM Act: We agree to use clear subject lines, include our physical address, and honor unsubscribe requests promptly.

Children's Privacy: The Platform is not intended for children under the age of 13. If we learn we have collected data from a child under 13 without parental consent, we will delete it.

10. Revisions

We reserve the right to modify this Privacy Policy at any time. Updates will be posted on this page.

11. Governing Law and Jurisdiction

This Privacy Policy will be governed and interpreted pursuant to the laws of the State of Israel without giving effect to its choice of law rules. You expressly agree that the exclusive jurisdiction for any claim or action arising out of or relating to this Privacy Policy shall be to the competent courts in Tel Aviv, Israel, to the exclusion of any other jurisdiction.
